4. Quotes, Estimates, and Service Agreements

Quotes and estimates provided through the Site, by phone, or in person are based on the information you provide and on initial inspections. Final pricing may be adjusted based on actual conditions observed at the property, the size of the area treated, accessibility, level of infestation, and other factors.

All ongoing services may be governed by a separate service agreement that outlines treatment frequency, pricing, term length, and cancellation terms. The terms of any signed service agreement take precedence over these general Terms.

5. Scheduling, Access, and Cancellations

By booking services with Pest Free LLC, you agree to:

– Provide accurate contact and property information
– Be present, or arrange access, at the scheduled service time
– Secure pets, children, and personal belongings as necessary before treatment
– Follow any pre-treatment or post-treatment instructions provided by our technicians

If you need to reschedule or cancel an appointment, please contact us as soon as possible. Cancellation or rescheduling policies for ongoing service plans will be outlined in your individual service agreement.

We reserve the right to reschedule services due to weather, safety conditions, technician availability, or other circumstances outside our control.

6. Pricing and Payment

Service prices are determined by the scope of work, property size, treatment type, and other relevant factors. Unless otherwise stated in a written service agreement:

– Payment is due upon completion of service
– We accept payment methods as communicated at the time of booking
– Late payments may be subject to a late fee or interest as permitted under Florida law
– Returned checks may incur a fee in accordance with Florida Statutes § 68.065

You are responsible for any costs of collection, including reasonable attorneys’ fees, in the event of non-payment.

7. Service Warranties and Guarantees

Specific warranties or guarantees, if offered, will be described in your individual service agreement or treatment proposal. Examples may include termite renewal warranties or retreatment guarantees on certain pest treatments.

Except for any warranties expressly stated in writing in a separate service agreement, all services are provided **”as is”** without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by law.

Pest control results can vary based on environmental factors, infestation severity, customer compliance with recommended actions, and conditions outside our control. We do not guarantee the complete elimination of any pest unless specifically agreed to in writing.

8. Customer Responsibilities

To support effective treatment outcomes and protect both customers and technicians, the customer agrees to:

– Provide safe and reasonable access to the property
– Disclose known allergies, sensitivities, or medical conditions of household members or pets that could be affected by treatment
– Inform us of any pets, livestock, beehives, or aquariums on the property
– Follow all post-treatment instructions, including waiting periods before re-entering treated areas
– Keep the property reasonably free of conditions that contribute to pest problems (such as moisture issues, food debris, or clutter), as untreated underlying conditions can affect results

Failure to follow technician instructions or disclose relevant property conditions may void any applicable service guarantee.

9. Limitation of Liability

To the fullest extent permitted by Florida law, Pest Free LLC, its owners, employees, contractors, and affiliates shall not be liable for:

– Any indirect, incidental, special, consequential, or punitive damages
– Damage to property due to pre-existing conditions, hidden defects, or conditions not reasonably visible at the time of service
– Damage to plants, lawns, or vegetation caused by factors outside our control, including weather, drought, disease, or non-compliance with care instructions
– Allergic reactions or sensitivities not disclosed prior to treatment
– Loss of income, profit, or business opportunity

Our total liability for any claim arising out of services provided shall not exceed the amount paid by the customer for the specific service giving rise to the claim, except where Florida law requires otherwise.

Nothing in these Terms limits liability for fraud, willful misconduct, or any liability that cannot be limited or excluded under applicable law.

10. Insurance and Licensing

Pest Free LLC maintains the licensing and insurance required to operate as a pest control and lawn care provider in the State of Florida. License and certification details are available upon request.
